国防大学女博士的报告_a lecture given by a PhD2006/11/29 A colonel also a PhD, Ms. Xu who came from National Defense University gave us a lecture about how to do research this afternoon. With her own research experience, she made a wonder speech especially on the arrangements of a dissertation. I benefit a lot although I don’t like writing scholar articles for I had just experienced my painful college dissertation months before. In the end of her lecture, she told us to read about 100 books related to our majors during the postgraduate program. This is a good suggestion. After almost a year’s trying out, the space puts up its plate. Fours major components are included as follows: Informatics (my major of postgraduate program); law (what I majored when I obtained B.A.); English language (a necessary tool to be international) and what I thought of in daily life (no love, no regrets, no personal issues just focus on what I have learned and what I need to learn and what I have succeeded in or failed at to avoid other ones take the same disastrous road as me). Years later after my death, I would be happy in the heaven (or in the hell, who knows?) that I had left something called cultural and ethical wealth to the human being’s development. I am responsible to what I said in this space and I will influence or inspirit others with an optimistic, enthusiastic, active and glorious attitude. Thanks for reading. 大公安VS大边防_YL之争 本周于周三的课上，YL如两位讼辩律师般的在Ms.D的主持下，针对大公安和大边防的提法大加辩驳，下课铃声给其了一纸悬案式的判决。用梁任公的话讲“言之无罪，闻者足兴”。然，对二者观点，并不苟同。Y从情报的实践出发认为不应进行独立的边防而应将其融入到公安的概念范围内，结合公安的刑侦、治安等等形成一种大的公安观念，而不应特别强调边防的军事性。L从本边防部队的部门利益出发，提出在边境地区边防部门比其他机关更有优势，要充分发挥这种优势不仅仅需要边防部门一家的努力，也需要各部门之间的协调沟通，形成以边防部门为主体的包括其他公安机关，国家安全机关以及军事机关等大的边防。 我认为，首先，边防部队是公安机关的组成部分，正式称谓的是公安边防部队，边防的前缀是公安，而不是解放军，也不是严格意义上的武警，边防与公安在逻辑上是种属关系，因此，现状是，边防再大也只能在公安内部“大”，而当下大公安是除边消警外的其他机关的大，似乎并没有体现大边防。其次，作为边防是国家安全的第一个屏障，也是国家安全的最后一道防线。必然地，要提高其在整个国家安全体系中的地位，尤其是在信息化愈演愈烈的今天，边防的任务愈来愈重，而不仅仅让它限于公安内部，可以设想成立一个部级的边防部，成员由普通行政官员（包括海关，检验检疫等），警察（包括移民警察，边境警察）和边防军队组成，一来便于协调部门利益，二来形成整体机制后，便于统筹管理，以“日趋于善”。这样的存活于想象中的边防才可称为“大边防”。 要而论之，二位在二个体系（前者在公安体系中，后者在国家边境安全防卫体系）中辩论两个概念，且所辩护之者，与对方之意,“相去岂可以道里记哉”？今专标私意，瞎喊一通，可能未解惑而惑上加或，善哉！ ARGUMENT ON CONCEPT OF EXPANDED PUBLIC SECURITY & EXPANDED NATIONAL SECURITY ——BASED ON DEBATEMENT BETWEEN SOCRATES YUAN AND JOURNALIST LIU PRESIDED OVER BY MS.D, YUAN AND LIU GAVE US A SHORTLY DEBATE ON THE CONCEPT SHOWED IN THE TITLE OF THIS ARTICLE. 读贺卫方《走向司法公正的八个制度要件》 周末里，看到了我电脑的F盘还有几篇文章没有读，想仔细咀嚼一下，写个读后感之类的。这是我读的第一篇，名字叫做《走向司法公正的八个制度要件》，感觉作者写得很漂亮，一方面因为我对司法知之甚少，他讲的每一个论点对于我来讲都是新的不能再新，不像我的专业一样，我能很快地从中分出陈年的抑或是新颖的；另一方面是对北大公法学人的admiration吧。 既然说是走向司法公正，谈一谈怎么走就成为必然的了，作者毫不含糊，提出行政权力不再主导经济生活，“法院正以前所未有的强度和深度进入到经济以及社会生活的调整过程中”，因此司法公正备受关注，因为对现状不满，需要改革，但同时改革本身也存有缺陷，换句话讲，改革本身也需要改革。用一个明显的缺陷作为例子，即改革囿于自身权限由不同司法机关提出，出现“盲人摸象”和“头痛医头”的现象，旧蔽未除复生新弊。摆明现状后，作者进而提出在全国人大的层面上，设立一个“司法改革特别委员会”，一来可以全方位考虑避免盲人摸象，二来可以制订一揽子的改革方案也可减少头痛医头的的治标疗法。 在对司法的现状以及提出战略高度的改革建议后，作者back to the muttons,指出实现司法公正，最重要的问题乃在制度，而非法官的个人品性等如是而已。作者指出的能够走到真正的司法公正的八个制度要件分别是： 第一，解决司法权实际上从属于地方，这个我也在课上听过老师讲法官的薪水由地方支出，那法官还谈什么司法独立啊？判个案稍不符合地方财政父母官的意志，直接扣了薪，那法官只能喝西北风。作者指出金融已经中央化，而比金融更需要中央化的实现社会正义的最后一道防线的司法，却“在一边晾着”，而且金融出了问题还要找地方法院，不免矛盾。作者还批判了法院“垂直领导”的策略。第二，改革法官的选任制度，一方面《法官法》的法官入门低门槛在现实操作中继续降低了；另一方面想成为法官者们看到原来《围城》里面的法官们也不过这般货色，“危邦不入，乱邦不居”，纷纷go away。第三，司法权的司法化问题，法院不仅仅是挂块牌子，它行使权力的方式跟行政机关不一样，如何不一样，值得思考。在大街上司法的法官不是法官是行政官。另外，司法如何避暗箱操作而公开等如何规范。第四，法院内部管理的行政化也是作者所批评的，存在审判委员会、院长批案，法官如何独立。法官权力虚化可将责任与荣誉推诿如何使其进取。第五，关于司法伦理的确立和执行机制。简要厘清司法伦理和司法犯罪后，作者认为“司法伦理一定是建立在对于司法官的职业特色清楚意识的基础上的一套行为准则”；在另一方面作者认为四方建设的一个重要事项是要有一个有效的执行机制，一来矫正有违反职业伦理行为的法官，二来保障法官的合法地位。第六，理顺不同的法律机关的关系， 一方面避免使得它们之间的相互配合相互制约变成职权混淆和斗气冲突，另一方面保护司法机关的公正形象；第七，处理好法院与人大之间的关系，作为最高权力机关的人大，对司法机关的监督权力应该体现且加强在对法院财政人事领域，而不是人大屈尊的“个案监督”。第八，司法机关与传媒的关系。一方面没有新闻自由就没有司法公正，因大众传媒可对国家权力进行监督；另一方面新闻传媒也可被滥用，人言可畏。作者指出这两种行业的异同：“新闻与司法两种行业的逻辑有明显的差异，新闻重情感的诉求，司法重理性的运用；新闻倾向快捷的报道，司法强调审慎的决策。” 由上面贺教授对司法公正的八个制度要件的审视，我想到边防（尤其是immigration这一块），是否可以借鉴一下，比如如何理顺出入境边防检查部门已经垂直领导却仍按行政区划设立各省的总队的矛盾；如何处理好边检部门的行政性质和军事性质以及准司法的性质；如何保障出入境旅客的人权；如何理顺边检部门与公安厅、口岸办的关系；如何处理好签发证件部门和出入境检查部门的关系，全国的出入境边检是否应该大一统的运作模式等等，是否可以借贺老师的分析方法分析一下走向现代化出入境管理的几个制度要件。但毕竟，有些制度问题涉及到体制问题，是深水区，或者说是雷区，怅然…… 电影《圆明园》_The moive Winter Palace 冲着这部电影的介绍和圆明园废墟遗址的几个见证着历史沧桑的柱子，我看完了这个电影，算是周末的消遣。这个介绍写得实在太漂亮，我就不好意思再班门弄斧，把它放在这里，算是给这部电影做个免费的广告。

I haven’t realized the significance of economics for a long time. It is such a wrong estimation of the subject. People living in the modern society cannot survive without the effects of economy and so does the construction of my major. Consequently, I borrowed a book named the basic theory of economics to get some ideas of the subject.
11.14's TEDA travelling 11月14日也就是我爸爸４８岁生日这天，我们去了趟天津经济技术开发区（Tianjin Economic-Technological Development Area）简称TEDA，中文叫作泰达，主要介绍了天津滨海新区。发现两位接待着的讲解特有水平，侃侃而谈。第一位即席，首先讲了一下由于我们一贯重视经济发展，而导致社会发展与经济发展不匹配，因此经济发展了就要反过来回馈社会——教育和义务活动，其次讲了一下泰达的社区教育，将教育当成一种享受(对文化艺术等的渴求)，而不是学历教育或者说职业教育，还拿中东作例子，最后他说是一名转业军人，并期待我们武警为经济发展的保驾护航的作用发挥得更好。第二位叫作王台（音译）吧，是位满头白发的老人，他讲的Teda成功的原因是天津政府的支持（3，5，8，10四个数字的支持），继而中央政府的支持以及他们对十一届五中全会“等”字的理解和泰达人的努力。其他的我记不大清楚了。 感觉我自己最大的收获就是： １．谈吐举止，讲话逻辑性强，向这两位前辈学习。 ２．带着思考去看待事情。 ３．一步一个脚印。 ４．对事情的看待要全面认真，比如说这次台处长对门户的三个解释（其中一个是门户是正道，既然开门了，再跳窗户就不对了），还有就是“等”字，以及港兴城兴还是城兴港兴的辩证关系等等，感觉自己看待问题还远不够全面，需要改进和提高。 14th, November,we went to TEDA （Tianjin Economic-Technological Development Area）to make an on-the-spot investigation, i learned a lot through the speeches of two leaders there, and i found i still need a lot to advance my ability including public speech,conscientious thinking and so on. I am on the way to my dream though I’ve no idea how far it is to approach. Whatever, I am lucky enough to be given a great opportunity and get a nice start. Thirdly, I desire to develop the ability to analyze and solve problems through the influence and cultivation of my friends and tutors here. During my four-year college life, I had just learnt how to memorize as much knowledge as possible, after graduation, however, I did not know how to use them, —just like the author Ralph Waldo Emerson said, we are shut up in schools’ and colleges’ recitation room for 10 or 15 years, and come out at last with a bellyful words and do not know a thing. Therefore I really need to know not only what I learned is but also why I learn it and how to use in this program and I will endeavor. I will be abided by the proceedings to the three goals above in the postgraduate program. And as my immediate-term planning, I may change them according to the accumulation of my experience which should never be neglected. And her nice affirming of my little achievements encouraged me a lot .Well, it’s a good start and I will try to persist to do this kind of thinking daily. Back to the muttons, I got to know many students’ points of view towards the improvement of education system through discussion on the question Caroline gave us in this class. And I thought we should put the factor of receiving an education fairly into consideration besides ways such as government subsidization, ability-oriented examination and so on. As we all know, we Chinese senior school students have to pass the College Entrance Examination to get the permit to study in the universities. However, we are not fairly treated though we take the same examination as we are divided into different categories like hierarchy in military according to the province we’re born in. Under this circumstance, students who take the examination in Henan or Shandong have a little opportunity to study in Tsinghua compared to students in Peking. Consequently, education improvement should start at fair treating to students in my opinion. |
